This Creator Representation Agreement (the "Agreement") is between The Collective Creator Agency (the "Agency") and the creator signing below (the "Creator").
1. Representation. The Creator appoints the Agency, on a non-exclusive basis, to represent the Creator for brand partnerships, sponsored content, affiliate campaigns, livestream collaborations and other TikTok Shop opportunities. The Agency may present the Creator to brands and sellers, pitch and coordinate campaigns, and connect the Creator's account to the Agency within TikTok Shop's Creator Agency Partner program.
2. Creator approval. The Agency will never commit the Creator to any deal, content, product or payment terms without the Creator's approval. The Creator may accept or decline any opportunity.
3. Compensation. The Agency takes 0% of the Creator's earnings. The Agency will not deduct commission or fees from the Creator's affiliate commissions, flat fees, retainers or other payments from brand opportunities. The Agency may separately receive compensation from brands, sellers or TikTok for its own services, and that compensation will never reduce the Creator's pay.
4. Non-exclusive. The Creator remains free to work with any brand, seller, agency or opportunity on their own.
5. Term. This Agreement lasts 12 months from the date signed. Either party may end it earlier with 30 days' written notice, including by email. Ending this Agreement does not affect deals the Creator already accepted.
6. Profile and performance information. The Creator authorizes the Agency to share the Creator's name, handle, content samples, audience information and TikTok Shop performance data with brands and sellers for the purpose of securing opportunities.
7. Creator responsibilities. The Creator will follow TikTok's Community Guidelines and TikTok Shop policies, use required disclosures for paid and sponsored content, and deliver any content they agree to on the agreed terms.
8. Independent relationship. The Creator is an independent creator, not an employee of the Agency, and is responsible for their own taxes.
9. Separate from membership. This Agreement is separate from the Creator's membership in The Collective. Signing is optional, and signing or ending this Agreement does not change the Creator's membership in any way.
10. Governing law. This Agreement is governed by the laws of the State of Florida.
11. Electronic signature. The Creator agrees that signing this form electronically is legally binding in the same way as a handwritten signature.
